[2. Discussion and possible action on a recommendation for the Austin Colony Section 1 Final Plat and a variance of Section 23-11.(I).3.]

ONE FINAL PLAT IN THE VARIANCE OF SECTION 23-11.3.

THIS IS A REQUEST FOR A REQUEST FOR A RECOMMENDATION OF APPROVAL FOR THE AUSTIN COLONY SECTION ONE FINAL PLAT.

THE VARIANCE REQUEST IS THAT SECTION OF THE LAND DEVELOPMENT CODE IS ABOUT THE NUMBER OF LOTS THAT YOU CAN HAVE ON A SINGLE ACCESS POINT.

AND IF YOU'LL RECALL BACK WITH THE PRELIMINARY PLAT APPROVAL, I HAD A LOT OF DISCUSSION IN THE STAFF REPORT ABOUT THE FACT THAT THE ROAD, WHICH IS NOW BEING CALLED AUSTIN COLONY BOULEVARD THAT CONNECTS TO TIGNER AND THEN THAT EXTENSION OF TIGNER OVER TO WHERE IT CURRENTLY STUBS OUT OVER TO THE EAST WAS ALL PART OF SECTION ONE, AND THIS VARIANCE WOULDN'T BEEN NECESSARY IF IT WAS BEING CONSTRUCTED AS PART OF SECTION ONE.

SO WE MET WITH THE DEVELOPER AND CAME UP WITH THIS APPROACH BY WAY OF THE VARIANCE WHICH YOU HAVE IN YOUR BACK UP.

THE VARIOUS ITEMS DISCUSSED BY THE DEVELOPER IS WHAT ON HOW THIS WOULD ALL WORK AS PART OF

THE VARIANCE AND THAT WILL GET THE ROAD CONSTRUCTED.

IT WILL ALLOW THEM TO START CONSTRUCTION ON THIS FIRST PHASE AND AFTER 50 LOTS ARE PERMITTED, THEY WOULD THEN HAVE TO CONSTRUCT THAT CONNECTION OF AUSTIN COLONY BOULEVARD TO TIGNER TO TIGNER.

SO THAT WOULD HAVE TO BE DONE BEFORE THEY COULD THEN COME BACK WITH THE NEXT SECTION OF THE PROJECT. SO THE VARIANCE IS ADDRESSING A TEMPORARY TIMING ISSUE, MORE THAN A PERMANENT REQUEST FOR A CHANGE, RIGHT? THAT'S EXACTLY WHAT IT IS.

IT'S A IT'S PUSHING KIND OF THE TIMING BACK ON THE CONSTRUCTION OF THE ROAD RATHER THAN JUST ELIMINATING CONSTRUCTION OF THE ROAD.

SO THEY'RE GOING TO CONSTRUCT THE ROAD, IT'S GOING TO BE THERE.

THERE WILL BE A SECOND ACCESS, YOU KNOW, BEFORE THEY GET TO MOVE ON TO ANOTHER SECTION.

AND IT WAS THE BEST COMPROMISE POSITION THAT COULD BE WORKED OUT GIVEN THE CIRCUMSTANCES, BECAUSE TO SOLVE EVERYTHING WOULD HAVE BEEN WOULD HAVE MEANT HAVING TO GO BACK THROUGH THE ZONING PROCESS AND AMENDING THE LAND PLAN FOR THE PROJECT.

SO THAT BEING SAID, STAFF RECOMMENDS APPROVAL OF THE AUSTIN COLONY, SECTION ONE FINAL PLAT AND THE VARIANCE SUBJECT TO THE CONDITIONS AS DETAILED IN ATTACHMENT FOUR.

DISCUSSION AND POSSIBLE ACTION ON THE PRELIMINARY REPLAT OF THE SECOND PHASE OF THE TIGER RESERVE SUBDIVISION.
