BUT REAL QUICK, WE'RE GOING TO TALK ABOUT THE NEW SCHOOL SITE AND GIVE YOU AN UPDATE ON THAT. THE HOUSING PRODUCT RESTRICTIONS, THE PARKS MASTER PLAN, WHERE WE ARE WITH ROAD STANDARDS, BOTH FOR YOU ALL AND WITH THE COUNTY. DISCUSSIONS ON THE 288 FRONTAGE ROAD CONCEPT AND THEN SAFETY AND SECURITY AND PARTICULARLY THE COUNTY AGREEMENT. ON THE SCHOOL DISTRICT, IF YOU'RE LOOKING AT THE OVERALL MASTER PLAN WHERE WE'RE TALKING ABOUT THIS PURPLE HERE, THEY ARE UNDER CONTRACT TO PURCHASE ROUGHLY 50 ACRES FOR AN ELEMENTARY SCHOOL AND MIDDLE SCHOOL. THAT IS SCHEDULED TO CLOSE IN JULY. THEY ARE PLANNING TO GET THESE SCHOOLS OPEN FOR FALL 2025. REALLY THIS DEVELOPMENT AGREEMENT AND THE APPROVAL OF THE WATER PLANS HAS BECOME A CRITICAL PATH ITEM. ONE OF THE THINGS WE'LL ASK YOU ALL TO GIVE STAFF DIRECTION ON TONIGHT IS JUST ALLOWING YOUR STAFF TO REVIEW AND COMMENT ON THE PLANS FOR THE WATER PLANT SO THAT, ASSUMING WE GET THE DEVELOPMENT AGREEMENT DONE, WE CAN MOVE FORWARD TIMING WITH THAT. THOSE PLANS HAVE ALREADY BEEN APPROVED BY TCQ, SO HOPEFULLY, THAT'S NOT A HUGE CHALLENGE. JUST PUT IN THE BACK OF YOUR MIND THE LOCATION OF THESE BALL FIELDS BECAUSE THAT'S GOING TO BE RELEVANT WHEN WE TALK ABOUT THE OVERALL PARK PLAN. THIS WAS, I THINK, DISCUSSED A LOT AT YOUR LAST COUNCIL MEETING AND WE'VE HAD A NUMBER OF DISCUSSIONS WITH YOUR STAFF, AND WE'VE NOW INCLUDED THIS IN THE LATEST DRAFT DEVELOPMENT AGREEMENT. WHAT WE'VE SAID ALL ALONG IS THAT THE WHOLE POINT OF THIS IS WE'RE GOING TO BE A MASTER PLAN WITH MULTIPLE PRICE POINTS. WE HAVE PROVIDED YOU WITH A MINIMUM OF FOUR PRODUCT TYPES, AND I SAY A MINIMUM OF FOUR. THIS 60-FOOT PLUS INCLUDES ACTUALLY MULTIPLE PRODUCT TYPES. WHAT WE HAD DONE THAT IS DIFFERENT IS WE HAVE REDUCED THIS MAXIMUM NUMBER BY 100. THAT'S AS LOW AS WE CAN GO WITH OUR DISTRICT THAT'S LESS, THAN I THINK, THREE AN ACRE STILL, SO IT'S STILL PRETTY GOOD. THEN PROBABLY MOST IMPORTANT TO EVERYBODY, WE HAVE AGREED THAT THE 50 FOOTERS WILL NOT EXCEED 50 PER CENT OF THE OVERALL UNITS. I THINK THERE WAS CONCERN AT THE LAST MEETING THAT WE COULD DO 70 PER CENT 50S, THAT WAS NOT THE INTENT, AND SO WE'VE ADDED THAT TO THE DRAFT AGREEMENT. ON THE DEED RESTRICTIONS, JUST A REMINDER, AND THIS IS A FAIRLY SIGNIFICANT COMMITMENT IN THIS DAY AND AGE, THAT WE'VE AGREED THAT WE WON'T DO ANY RENTAL COMMUNITIES. THERE WON'T BE ANY COMMERCIAL RENTAL COMMUNITIES LIKE I THINK YOU'VE SEEN IN OTHER PLACES ON 288. WE'VE MADE SIGNIFICANT COMMITMENTS ON WHAT THE ARCHITECTURE WILL LOOK LIKE. YOU ALL DON'T HAVE THE OPPORTUNITY TO REGULATE THAT ANYMORE, [00:45:02] BUT WE HAVE MADE COMMITMENTS ON THAT. BRICK AND STONE ON THE FRONT AND THE SIDES, AND THEN FRONT HOME ELEVATION REPETITION RESTRICTIONS. I DON'T KNOW IF YOU ALL ARE FAMILIAR WITH THIS, BUT THIS MEANS YOU CAN'T HAVE THE SAME FRONT ELEVATION RIGHT NEXT TO EACH OTHER, SO THERE'LL BE RESTRICTIONS ON WHAT THAT LOOKS LIKE. ALL OF THOSE, OF COURSE, CONTRIBUTE TO THE OVERALL LOOK AND FEEL OF THE COMMUNITY AND IS TYPICAL OF WHAT THESE GUYS DO. BUT WE'VE PUT THAT IN THE AGREEMENT, AND WE'VE GIVEN YOU RIGHTS TO ENFORCE THAT IF YOU DECIDE TO DO THAT. ON THE 288 FRONTAGE AND THE COMMERCIAL CENTER, WE HAD ASKED FOR TWO YEARS. YOU ALL HAD WANTED, I THINK MAYBE WE ASKED FOR THREE YEARS, AND YOU ALL HAD WANTED SIX YEARS. THEN I THINK THE START DATE WAS A BIT OF A DISCUSSION. WHAT WE HAVE PROPOSED IS REALLY A FOUR-YEAR HOLD ON THESE 62 ACRES. TWO YEARS TO GET THE DEAL DONE WITH THE COUNTY AND THE CITY AND TXDOT TO SECURE AN AGREEMENT THAT WOULD ALLOW US TO DO FRONTAGE ROADS HERE. THEN TWO YEARS, ONCE THAT AGREEMENT IS DONE, FOR THE TXDOT TO START WORK, OR WHOEVER TO START THE WORK. THIS CAME UP AT OUR MEETING LAST WEEK WITH YOUR STAFF, WHICH YOUR STAFF HAS BEEN GREAT. IT WAS A VERY PRODUCTIVE AND LONG MEETING TO TRY TO GET THROUGH A LOT OF THIS. THE TWO-YEAR TIME FRAME ON THIS IS REALLY NOT FOR US, IT'S FOR YOU-ALL AND FOR THE COUNTY. WHAT I MEAN BY THAT IS, I THINK IF THE CITY AND THE COUNTY ARE REALLY BEHIND GETTING THE FRONTAGE ROAD PROJECT DONE, TXDOT IS CERTAINLY MORE RECEPTIVE TO THE CITY AND THE COUNTY PUSHING IT. IF WE GO AS PRIVATE LANDOWNERS, WE WILL NOT HAVE MUCH SUCCESS. PART OF THE REASON THAT WE WANT TO HAVE THAT TWO YEARS IN THERE IS WE WANT YOU GUYS AND WE WANT THE COUNTY TO BE INCENTIVIZED AND MOTIVATED TO WORK HARD TO GET THAT DEAL DONE WITH TXDOT. THE QUESTION YOU GOT TO ASK IS, "WELL, WHAT HAPPENS IF WE'RE CLOSED AND THE TWO YEARS EXPIRE?" LOOK, IF WE CAN DEVELOP THIS AS COMMERCIAL, WE WANT TO DO THAT. WE JUST HAVE TO HAVE, "HEY, IT'S NOT GOING TO HAPPEN." WE'VE GOT TO HAVE SOME CERTAINTY THAT WE'RE NOT HANGING ON FOREVER. AGAIN, THERE'S A LOT OF IT IN HERE THAT ARE MINIMUMS. THESE ARE THE MINIMUMS. IF WE'RE CLOSE TO AN AGREEMENT WITH TXDOT AT YEAR TWO, I MEAN, NO REASON WHY WE WOULDN'T CONTINUE TO WORK TOWARDS THAT. BECAUSE OBVIOUSLY, IF WE CAN DO COMMERCIAL LONG 288, THAT'S BETTER FOR US. THAT'S BETTER FOR YOU ALL. THEN MOST RECENTLY, JUST NORTH OF THIS, THIS TRACKED HERE, THERE'S ANOTHER 35-ACRE TRACK THAT WE HOPE TO BRING INTO THE DEVELOPMENT. IT'S NOT PURCHASED YET, BUT THAT COULD EXPAND THE COMMERCIAL PIECE BY ANOTHER 50 PER CENT. YOU GIVE US ALMOST 100 ACRES OF COMMERCIALS. AGAIN, I THINK WE'RE ALL INVESTED IN GETTING THE DEAL DONE WITH TXDOT. WE'VE MADE A COMMITMENT THAT WE'LL WAIT AT LEAST FOUR YEARS TO DEVELOP THAT FOR A SINGLE FAMILY. I HOPE YOUR ALL'S COMMITMENT WILL BE THAT YOU ALL WILL HELP US IN EVERY WAY TO TRY TO GET THAT DONE. AS A REMINDER, YOUR AGREEMENT INCLUDES A STRATEGIC PARTNERSHIP AGREEMENT WITH THE MUD THAT ALLOWS YOU TO EXTEND YOUR SALES TAX OVER TO THIS COMMERCIAL, SO YOU GET SOME OF THE SALES TAX. THE TYPICAL DEAL IS WE USE A PORTION OF THAT TO PAY FOR SOME OF THE COSTS OF THE FRONTAGE ROAD TO THE EXTENT WE CAN'T GET TXDOT TO PAY FOR IT. BUT OBVIOUSLY, THIS WOULD BE A WIN FOR EVERYBODY, AND WE HOPE TO GET IT DONE. SAFETY AND SECURITY AND THE INNER LOCAL WITH THE COUNTY. I MET ON MARCH 8TH WITH MATT HANKS AT THE COUNTY AND WITH THE COUNTY ATTORNEY'S OFFICE. WE WENT THROUGH THERE IN A LOCAL THAT THEY HAVE USED MORE RECENTLY IN OTHER DEVELOPMENTS. WE'LL COME BACK AND TALK ABOUT ROADS HERE IN A SECOND, BUT THEIR BIG ISSUE WAS SAFETY/SECURITY. REALLY IF YOU RECALL, THEY WERE CONCERNED ABOUT ENFORCING NOISE, AND NUISANCE, AND FIREWORKS, AND FIREARMS. WHILE IT'S NOT IN THE COUNTY AGREEMENT, WHAT WE HAVE PUT IN YOUR AGREEMENT IS THAT THE CITY, ONCE THEY ENTER WITH THE DEVELOPMENT AGREEMENT, CAN EXTEND TO OUR PROJECT, YOUR ORDINANCES ON NUISANCE, NOISE, FIREARMS DISCHARGE, AND FIREWORKS DISCHARGE. FOR PURPOSES OF OUR PROJECT, YOUR ORDINANCES ON ALL THAT WILL BE APPLIED TO OUR PROJECT. I THINK THAT'S SOMETHING NEW AND DIFFERENT. I THINK IT WILL GO A LONG WAY TO ADDRESS SOME OF THE CONCERNS THE COUNTY HAD. WE'VE ALSO AGREED TO PAY FOR TRAFFIC ENFORCEMENT DURING THE INITIAL PHASES AND WE HAVE A CONCRETE PROVISION IN OUR AGREEMENT WITH THE COUNTY THAT SAYS ONCE WE HIT 1,000 HOMES, THE MUD WILL PAY FOR ONE FULL TIME DEPUTY TO PROVIDE ADDITIONAL PATROLLING. [00:50:05] AGAIN, THAT'S A MINIMUM. THE MUD COULD ALWAYS DECIDE TO DO MORE, BUT WE HAVE MADE A FIRM COMMITMENT TO ADDRESS THAT WITH THE COUNTY AS WELL. I THINK THAT WE'RE PRETTY CLOSE, AT LEAST WITH THE STAFF AT THE COUNTY LEVEL. WE HAVE NOT YET GOTTEN ANY FEEDBACK FROM THEM. I'M ASSUMING THEY'VE GIVEN THAT TO THEIR COMMISSIONERS COURT, BUT WE'LL WORK BETWEEN NOW AND APRIL 11TH TO TRY TO GET THAT HAMMERED OUT SO THAT EVERYBODY IS COMFORTABLE WITH THAT. WE'VE ALSO PROVIDED ALL OF THE DOCUMENTS THAT WE HAVE ON THIS AGREEMENT TO THE COUNTY AND THEIR ATTORNEYS AND THEIR ENGINEERS. THEY SEE WHAT WE'RE DOING ON OUR AGREEMENT AND I HAVE PROVIDED A DRAFT OF THE INNER LOCAL WITH THE COUNTY TO YOUR STAFF AND YOUR ATTORNEY. EVERYBODY GOT ALL THE AGREEMENTS AND EVERYBODY CAN SEE WHAT EVERYBODY IS DOING. I KNOW THERE WERE SOME EARLY CONCERNS ABOUT NOT COMMUNICATING, I THINK WE'VE GONE ABOVE AND BEYOND TO ADDRESS THAT. I THINK WE WILL PROBABLY HAVE TO MEET WITH THE COUNTY COMMISSIONERS BEFORE THE 11TH. WE'LL TRY TO GET THAT DONE AND WE'LL REPORT BACK TO YOU ON HOW THOSE GOES. THEY HAD NOT SEEN THE LOT SIZE RESTRICTIONS THAT WE JUST PUT UP. MAYBE NOT TO THEIR COMPLETE SATISFACTION, BUT I THINK WE'VE ADDRESSED ALL OF THE ISSUES THAT WERE ON THEIR LIST OF CONCERNS. AT LEAST WE'VE SHOWN WE'VE DONE WHAT WE CAN [NOISE] TO TRY TO AMELIORATE SOME OF THOSE CONCERNS. ROAD STANDARDS. THIS HAS OBVIOUSLY BEEN A BIG TOPIC FOR AWHILE. THIS IS JUST AN ILLUSTRATION OF OUR COLLECTOR CROSS-SECTION. WE WILL HAVE AN ILLUSTRATION LIKE THIS FOR EACH TYPE OF ROAD IN OUR DEVELOPMENT AGREEMENT. THERE IS ONE MAJOR THOROUGHFARE, THAT EAST-WEST MAJOR THOROUGHFARE. THE COUNTY HAS AGREED THAT THEY WILL TAKE THAT AND MAINTAIN IT. WE'LL BUILD THAT TO THEIR STANDARDS AND THEY WILL MAINTAIN THE MAJOR THOROUGHFARE. THE COLLECTOR ROADS WE WILL BUILD TO [NOISE] THE COUNTY STANDARDS, SO WIDER PAVEMENT, DEEPER SUBGRADE. THEY WILL NOT MAINTAIN IT, IT WILL BE MUD MAINTAINED, BUT IT WILL BE BUILT TO THE COUNTY STANDARDS. THEN THE INTERNAL ROADS, WE HAVE ACTUALLY AGREED, AND I DON'T EVEN KNOW THAT THE CITY KNOWS THIS YET, BUT AT THE LAST MEETING, THE CITY ASKED US TO CONSIDER GOING FROM A SIX-INCH SUBGRADE TO AN EIGHT-INCH SUBGRADE, WHICH IS ACTUALLY NOT YOUR STANDARD. IT'S HIGHER THAN YOUR STANDARD. WE'VE CRUNCHED THE NUMBERS. IT'S SOMEWHERE BETWEEN HALF A MILLION AND A MILLION DOLLARS TO MAKE THAT CHANGE AND WE'VE AGREED IN THIS LATEST DRAFT TO DO THAT. WE'LL HAVE THE THICKER SUBGRADE ON EVEN THE LOCAL STREETS AND THEN THE MUD, OF COURSE, WILL MAINTAIN THOSE UNTIL YOU ALL ANNEX. THEN ONE OF THE THINGS THAT I HAD REALLY NOT PICKED UP ON, BUT IS WORTH SHOWING HERE, WHEN YOU LOOK AT THIS RIGHT AWAY FOR THE COLLECTOR, IT'S A 70 FOOT WIDE RIGHT OF WAY WITH THE RIGHT OF WAY LINE STOPS HERE. THAT MEANS IT'S GOING TO BE AS TOUGHER FOR THE CITY TO HIRE PEOPLE. WHEN IT'S TOUGHER TO HIRE PEOPLE, THE WAGES WE HAVE TO PAY GOES UP. >> NOW, THIS CHART SHOWS THE UNITED STATES INFLATION RATE. THE FIRST ONE IS A BILL TO ELIMINATE PROPERTY TAXES BY THE YEAR 2033. THE SECOND BILL IS TO CHANGE THE FORMULA FOR HAVING TO CALL AN ELECTION FOR REVENUE INCREASES, HOUSE BILL 2020, WHICH SAYS THAT ANY REVENUE INCREASE MUST GO BEFORE THE VOTERS. THESE ELECTIONS HAVE TO OCCUR IN NOVEMBER, OUR BUDGET HAS TO BE PASSED BY OCTOBER, 1ST. I DON'T KNOW HOW THAT COULD LOGISTICALLY WORK. THE NEXT TWO BILLS ARE TOGETHER. HOUSE BILL 3455 IS ANOTHER BILL THAT ELIMINATES PROPERTY TAXES, BUT IT DOES THAT BY THE YEAR 2029. THEN THE BILL RIGHT BELOW IT IS A STATE CONSTITUTIONAL AMENDMENT TO ELIMINATE PROPERTY TAXES IN THE STATE OF TEXAS. I DON T THINK THOSE ARE GOING TO PASS THIS YEAR. I THINK THAT THERE'S A POSSIBILITY IN THE FUTURE SOMETHING LIKE THAT MIGHT HAPPEN, BUT PERSONALLY I DON'T EXPECT THAT. THE SENATE PASSED THEIR PROPOSAL WHICH INCLUDES INCREASING THE HOMESTEAD EXEMPTION FOR SCHOOL DISTRICTS TO $70,000, AND THAT'S HOW THE SENATE WANTS TO LOWER PROPERTY TAXES BY INCREASING THE EXEMPTION. THE HOUSE PROPOSAL AS IT STANDS RIGHT NOW IS TO LOWER THE APPRAISAL CAP FROM 10% INCREASE TO 5% INCREASE. THERE'S DEBATE ABOUT BOTH APPROACHES. THE PRO SIDE SAYS, YES, THIS WILL WORK, THE CON SAYS, NO, IT WON'T WORK. WE'LL JUST HAVE TO WAIT AND SEE WHAT COMES OUT. BOTH OF THESE PROPOSALS WOULD USE THE SURPLUS REVENUE THE STATE HAS OF ABOUT $33 BILLION THIS YEAR TO FUND THESE TWO PROPOSALS. THE CITIES REALLY WOULDN'T SEE ANY OF THAT BECAUSE THAT WOULD ALL GO TO SCHOOL DISTRICTS. NOW, LET'S TALK ABOUT OUR OWN PROPERTY TAX. THERE ARE THREE THINGS THAT WE HAVE TO DEAL WITH IN OUR PROPERTY TAX. THE NO NEW REVENUE RATE IS THE RATE THAT WE SET THAT SAYS WE'RE GOING TO GENERATE THE SAME AMOUNT OF PROPERTY TAX THIS YEAR AS WE DID LAST YEAR. THE PREMISE BEHIND IT IS THAT AS LONG YOUR PROPERTY VALUES GO UP, YOUR PROPERTY TAX RATE GOES DOWN, AND SO YOU'RE LOWERING THE TAX RATE BUT YOU'RE STILL CREATING THE SAME AMOUNT OF REVENUE. THE VOTER APPROVAL RATE IS THE NO NEW REVENUE RATE PLUS 3.5%. IF WE GO ABOVE THAT RATE WE HAVE TO HAVE A PROPERTY TAX ELECTION. THE DE MINIMIS RATE IS ONLY FOR CITIES WITH LESS THAN 30,000 POPULATION, WHICH WE ARE, AND IT'S THE SUM OF THE NO NEW REVENUE RATE PLUS THE RATE THAT WOULD GENERATE AN EXTRA $500,000 IN TAX REVENUE. ONE OF THE PROPOSALS THAT I TALKED ABOUT EARLIER WOULD GET RID OF ALL OF THAT ESPECIALLY THE DE MINIMIS RATE. NOW, SALES TAX.
