OKAY. SO, OUR FIRST ACTION ITEM WILL BE DISCUSSION OF POSSIBLE ACTION ON THE MINUTES FOR THE PLANNING AND ZONING COMMISSION MEETING HELD ON JUNE 6TH, 2024.

GOOD AFTERNOON, COMMISSIONERS, AND GOOD AFTERNOON.

THIS IS A REQUEST, AS NOTED, FOR A REZONING PETITION FOR LAND LOCATED AT THE ADDRESS IS NOTED 728 TO 744 EAST HENDERSON, WHICH IS AN EXISTING SHOPPING CENTER.

THE OWNERS OF THE PROPERTY HAS SUBMITTED YOUR REA DOES NOT HAVE ANY PLANS TO IMPROVE THE ACTUAL PROPERTY IN QUESTION HERE. THIS HAS TO DO WITH THE LAND USE CONSISTENCY IN TERMS OF THE C G GENERAL COMMERCIAL DISTRICT REQUEST.

SO THE PROPERTY APPARENTLY IS ZONED AS YOU KNOW, ON THE MAP, WHICH IS THE NEXT GRAPHIC AS COMMERCIAL OFFICE RETAIL.

AND THERE ARE SOME USES WITHIN THAT DISTRICT THAT ARE NOT REQUIRED, BUT THEY'RE REQUIRED IN THE COMMERCIAL GENERAL.

SO, THE OWNERS OF THE PROPERTY WANT TO TRY TO FULLY USE THE SHOPPING CENTER FOR ITS WORTH IN TERMS OF COMMERCIAL GENERAL.

AND THEN THERE'S AN APPLICATION THAT WILL PROCEED, WHICH IS CONTINGENT UPON THE SUCCESSFUL VOTING OF THIS PARTICULAR ITEM.

I ALSO ATTACHED SOME INFORMATION THAT WAS A PREVIOUS REZONING FOR NEIGHBORING PROPERTIES.

JUST TO THE WEST IS COMMERCIAL GENERAL.

ON THE ZONING MAP AND THOSE PROPERTIES HIGHLIGHTED WITH THE SLASHES WERE THE ONES THAT WERE ZONED TO COMMERCIAL GENERAL, AND THEN THE TWO IN THE MIDDLE, THE DAYCARE TO THE FAR TO THE IMMEDIATE WEST AND THIS SUBJECT PROPERTY WERE LEFT COMMERCIAL OFFICE, UNFORTUNATELY.

SO THEY'RE JUST ASKING THIS EVENING, AS PART OF THIS PUBLIC HEARING, THAT YOU WOULD CONSIDER THIS REQUEST.

WE HAVE GIVEN YOU THE CRITERIA FOR REZONING FOR YOU TO WEIGH IN ANY TYPE OF IMPACTS, BUT WE SEE NO NEGATIVE IMPACTS ON THE AREA.

STAFF IS RECOMMENDING A POSITIVE RECOMMENDATION FOR THIS REQUEST TO BE SENT ON TO COUNCIL.

JUST DISCUSSED 740 EAST HENDERSON ROAD.

THE APPLICANT HERE IS REQUESTING AN SUP, WHICH IS A SPECIFIC USE PERMIT APPROVAL REQUEST BY ORDINANCE AT THIS PARTICULAR LOCATION IN THE COMMERCIAL GENERAL DISTRICT.

MR. MUNIZ IS TRYING TO MOVE HIS TATTOO SHOP INTO THE CITY.

AT THIS PARTICULAR LOCATION, WE'VE GIVEN YOU ALL THE INFORMATION FROM THE STATE DEPARTMENT OF HUMAN SERVICES OR HEALTH SERVICES, WHICH WOULD MONITOR AND LICENSE THESE BUSINESSES AND THE PROCESS FOR TATTOOING HAS CHANGED AND REVOLVED OVER TIME IN TERMS OF THE CLEANLINESS OF IT.

AND ALL OF THAT IS EXPLAINED IN THE STAFF REPORT.

AS PART OF THAT SPECIFIC USE PERMIT, WE USUALLY WOULD GIVE YOU WHETHER OR NOT IT'S CONSISTENT WITH THE AREA OR IF THERE'S ANY ISSUES OF CONCERN.

WE ALSO LISTED A NUMBER OF CONDITIONS THAT ARE CUSTOMARY FOR THE SPECIFIC USE PERMIT.

AND WE TRY TO LET THE APPLICANTS KNOW THAT SOMETIMES HOURS OF OPERATION OF PARTICULAR SPECIFIC USES COME INTO PLAY DEPENDING ON IF THEY, IF THEY ARE LOCATED ADJACENT TO RESIDENTIAL.

JUST TO KEEP IT CONSISTENT.
