HAVE ONE PUBLIC HEARING AND ACTION ITEM TODAY WE NEED TO CONDUCT A PUBLIC HEARING DISCUSSION AND TAKE POSSIBLE ACTION ON A REQUEST FOR A VARIANCE TO THE CODE OF ORDINANCES.SECTION 28 DASH 45 SF DASH 7.2, SINGLE FAMILY RESIDENTIAL DASH 7.2 ZONING DISTRICT D TWO MINIMUM FRONT YARD SETBACK TO ALLOW FOR A CARPORT TO BE PLACED IN THE FRONT YARD WITH A RE WITHIN A REDUCED FRONT YARD LINE OF 17 FEET, PLUS OR MINUS FROM THE RIGHT OF WAY.
THE SUBJECT PROPERTY IS LOCATED AT 3 0 4.

WE WILL FIRST HEAR FROM STAFF FOLLOWED BY THE APPLICANT.

UM, WE ARE PRESENTING THIS APPEAL TO YOU AS PRESENTED AND APPLIED FOR BY THE OWNER, UH, FOR THE CARPORT, WHICH IS A REPLACEMENT OF AN EXISTING CARPORT THAT WAS UNFORTUNATELY, UM, DESTROYED BY THE LAST STORM.
UM, AND THEY ARE BASICALLY REQUESTING THAT THE, UM, CARPORT BE REPLACED IN THE SAME POSITION, UM, BECAUSE OF OUR ORDINANCES, CODE OF ORDINANCES SECTION 7.2 DISTRICT, THE MINIMUM FRONT YARD REQUIREMENT, UM, WOULD DEEM THIS, UM, NOT POSSIBLE.
SO THEY ARE ASKING THAT IT BE PLACED AT THAT LIMIT OF THE 17 OR SO FEET FROM THE RIGHT OF WAY.
UM, WE HAVE PROVIDED YOU WITH THE STAFF REPORT ALL OF THE ATTACHMENTS IN TERMS OF THE SURROUNDING, UM, CONDITIONS OF THE PROPERTY AS YOU SEE IN THE AERIAL VIEW.
AND IF YOU HAVE, UM, TRAVELED ALONG THE STREET, THERE ARE A NUMBER OF CARPORTS THAT ARE ALONG THE RIGHT OF WAY, UM, WHICH WOULD NOT COMPLY WITH TODAY'S ORDINANCE REQUIREMENTS.
UM, SO THAT'S BEING BROUGHT BEFORE YOU.
THE APPLICANT IS HERE ALONG WITH A COUPLE OF NEIGHBORS AND THEY'LL PRESENT, UM, BASICALLY, UM, WHAT THEY'RE REQUESTING.
THESE ARE JUST SOME, UM, VIEWS, UM, TAKEN PRIOR TO THE STORM AND ALSO SOME CURRENT VIEWS ALONG THE STREET RIGHT AWAY.
UM, THAT SHOWS A LOT OF THE OTHER CARPORTS, UM, EXISTING CONDITIONS.
WE HAVE ALSO LOOKED AT THE, UM, ANALYSIS IN TERMS OF THE CRITERIA FOR GRANTING APPEALS.
AND IN TERMS OF ANY IMPACTS ON THE SURROUNDING COMMUNITY, THERE ARE NONE.
UM, THIS IS A REASONABLE REQUEST AS WE STATED BECAUSE OF, UM, THE STORM EVENT AND, UM, THERE ARE MORE THAN FIVE HOMES IN THE IMMEDIATE VICINITY OF THE AREA IN WHICH THE CARPORTS DO EXIST.
THE APPLICANT IS, UM, SEEKING RELIEF OF THIS, UM, TO ALLOW FOR THE CARPORT DUE TO ACCESSIBILITY AND WALKING ASSISTANCE IN WHICH THEY, UM, HAVE TO DEAL WITH AND ALSO TO BE PROTECTED FROM THE WEATHER.
AND THEY ARE, UM, NOT ASKING FOR ANYTHING THAT WOULD BE DETRIMENT, DETRIMENT TO PUBLIC HEALTH AND SAFETY OF THE SURROUNDING AREA.
UM, GRANTING THIS PARTICULAR APPEAL, UH, WOULD NOT PREVENT ANY ORDERLY USE OF LAND WITHIN THE AREA.
UM, SO I THINK THAT THE BOARD WITH ALL OF THAT INFORMATION COULD ESTABLISH A FINDING OF FACT THAT IS JUSTIFIABLE TO GRANT THE VARIANCE.
SO THAT'S WHAT WE HAVE BEFORE YOU.

NOT THE STREET OR CURB OR, OR THE CENTER OF THE STREET.
OURS IS FROM THE PROPERTY LINE, WHICH HER HOUSE, YOU KNOW, IS NOT, SHE DON'T HAVE, ONCE YOU HIT THE PROPERTY LINE AND MEASURE BACK 25 FEET, SHE, SHE DOESN'T HAVE A LOT THERE.
WELL THAT'S, THAT'S PROBABLY, UH, THE SAME FOR EVERYBODY ON THAT STREET.
AND A LOT OF THOSE CARPORTS ARE OLDER OR BEFORE THE ORDINANCE.
SO HOW DO WE FIND THE PROPERTY LINE WATER METER WATER METER'S THE EASIEST USUALLY, I MEAN, WITHOUT A SURVEY BEING EXACT WATER METER IS JUST ON OUR SIDE IN THE EASEMENT.

AND THAT CARPORT HAS PROBABLY BEEN THERE FOR 50 YEARS OR THEREABOUTS.
AND I'M CERTAINLY IN FAVOR OF SEEING THAT CARPORT RE-ERECTED, UH, LIKE SHE HAD IT.
AND, UH, THAT'S ABOUT ALL I'VE GOT TO SAY, BUT I JUST HOPE THAT YOU FOLKS CAN FIND IT IN YOUR HEART TO GRANT THIS IN FAVOR OF REBUILDING THAT CARPORT BECAUSE SHE'S ALREADY ORDERED THE THING AND IF SHE CANCEL, SHE'S GONNA LOSE HER DOWN.
